We are frequently instructed at the point at which a course of action is being weighed rather than implemented: entry into a new market or category, adoption of a revenue model of uncertain regulatory standing, restructuring of ownership, response to a competitor, or the assessment of an opportunity carrying unfamiliar exposure. Where an event has already placed the business under scrutiny, the requirement is a single point of legal judgement coordinating the response, the correspondence and the record — promptly, and with a clear sense of what will later be examined and by whom. The deliverable in such engagements is a written opinion setting out the options, the exposure attaching to each, and a reasoned recommendation.
